OpenWebZim Terms & Conditions

Welcome to OpenWebZim! These terms explain how www.openweb.co.zw (our platform) works, what you can expect from us, and what we expect from you. By using our platform, you agree to these terms.

 

(Create an account)

If you are an individual

You must be at least 18 years old to register an OpenWeb account to shop on our platform. You must also be legally able to enter into contracts in Zimbabwe.

If you are a business

If you are a business, you can register an OpenWeb business account subject to the business terms. You also warrant that all information you submit to OpenWeb about yourself or your business is accurate and up to date.

 

(Keeping your OpenWeb account secure)

Please keep your username and password private. This is to keep your information safe and to prevent anyone from misusing your OpenWeb account. You carry the risk of unauthorised and fraudulent activities on your OpenWeb account. If you suspect or know that there is unauthorised access to your OpenWeb account, you must notify us immediately. You must also take steps to mitigate any resultant loss by changing your password and blocking the payment cards you loaded onto your OpenWeb account.

 

(Our Platform)

  1. We get information from Service Providers, and we can’t guarantee that everything is accurate – but when providing our Platform, we take reasonable care and act with professional diligence. Unless we’ve failed to do so or have been negligent, we can’t be held responsible for any errors,interruptions, or missing bits of information. Of course, we’ll do everything we can to correct/fix them as soon as we become aware.
  2. Our Platform is not a recommendation or endorsement of any Service Provider or its products, services, facilities, vehicles, etc.
  3. We’re not a party to the terms between you and the Service Provider. The Service Provider is solely responsible for the final Consumer Experience.
  4. To make a purchase, you may need to create an Account. Make sure all your info (including payment and contact details) is correct and up to date, or you might not be able to access your Shopping Product(s). You’re responsible for anything that happens with your Account, so don’t let anyone else use it and keep your username and password secret.
  5. We’ll show you the offers available to you.
  6. Unless otherwise indicated, you must be at least 18 to use the Platform.

 

(You promise to use our site responsibly)

You agree that you will not:

use any device, software, or other instrument to interfere with the operation of our platform;

use any robot, spider, other automatic device, or manual process to monitor, copy, distribute, or modify our platform or its content, except for technology used by internet search websites to direct internet users to our platform; and use our platform to distribute material that is defamatory, offensive, contains or amounts to hate speech, or is otherwise unlawful.

 

(We own the platform and content)

We own and operate the platform. When you use our platform, you’re getting permission to browse and shop, but you don’t get ownership of any content or part of our platform.

The platform content is the property of OpenWeb, its advertisers, sponsors, or is licensed to OpenWebZim. The content is protected by law, and you may not use, distribute, or reproduce it without the property owner’s written consent.

We may change, suspend, or terminate our platform at any time without notice or with reasonable notice.

 

(Modification clause)

  1. We may make changes to these Terms. Where such changes are material, we will inform you in advance of such changes becoming effective, unless the changes are required by applicable law.
  2. If you do not accept the changes, do not use our Platform.
  3. Otherwise, your continued use of our Platform after the effective date of the proposed changes will constitute your acceptance of the revised Terms.
  4. Any existing use or purchase will continue to be governed by the Terms that applied when the purchase was made.

 

(Applicable law and forum)

These Terms are governed by Zimbabwean law. You can also rely on Zimbabwe national consumer rights.
